Borough Assembly Approves Changes to Subdivision Code

March 6, 2012 Update 

On February 9, 2012, the FNSB Assembly approved a substitute ordinance, proposed by Assemblyman Davies, amending Title 17.  The substitute ordinance removed the requirement for soils testing prior to road construction that was initially included in the Mayor’s ordinance.  In addition, the surety amount was reduced from 10% of the Borough engineer’s cost estimate for road construction to 5%. 

Ordinance 2011-61, as adopted, made the following changes to Title 17: 

1.  Clarified that subdivision roads must be constructed taking into account the conclusions and recommendations as shown in the typical roadway cross section submitted with the preliminary plat. 

2.  The owner must warrant and guarantee that the required improvements will remain within the specifications of Title 17 for two years (increased from one year). 

3.  The owner must provide a surety in the amount of five percent (5%) of the borough engineer’s cost estimate of the required improvements to guarantee that the required improvements will remain within the specifications of Title 17 during the two-year warranty period. 

4.  A minimum of three inspections are required to be performed by the developer’s registered professional during road construction. 

5.  The developer’s registered professional is required to provide a report summarizing his/her inspection findings.
